This Vacation Rental Agreement (“Agreement”) outlines the terms and responsibilities associated with your stay at a Vacation Wimberley property. By booking a reservation, submitting payment, or occupying the property, the Guest agrees to the terms below.
This Agreement is entered into between:
Vacation Wimberley, LLC (“Owner” or “Manager”)
and
The individual making the reservation (“Guest”).
The primary Guest making the reservation must meet the minimum booking age requirement for the selected property:
Properties accommodating 4 or more guests require the booking Guest to be at least 25 years old unless otherwise approved in writing by Vacation Wimberley.
Properties accommodating up to 2 guests require the booking Guest to be at least 21 years old unless otherwise approved in writing by Vacation Wimberley.
The booking Guest must remain on the property for the duration of the reservation unless otherwise approved in writing.
Reservations may not be transferred, assigned, sublet, or booked on behalf of another party without prior written approval from Vacation Wimberley.
By completing the reservation, the Guest confirms they meet the applicable minimum age requirement and accept responsibility for all members of their party during the stay.
The reservation confirmation provided at booking, including:
property selected,
stay dates,
occupancy limits,
pricing,
fees,
and cancellation terms,
is incorporated into this Agreement by reference.
All reservation payments must be completed according to the payment schedule provided during booking.
Vacation Wimberley reserves the right to:
cancel unpaid reservations,
refuse occupancy,
or charge for damages, excessive cleaning, missing items, policy violations, or unauthorized guests.
Guests are responsible for any damage caused during the reservation period beyond normal wear and tear.
Guest authorizes Vacation Wimberley to charge the payment method on file for approved damages, excessive cleaning, policy violations, missing items, unpaid fees, smoke remediation, or other charges permitted under this Agreement.
Only registered guests included in the reservation may stay overnight at the property.
Maximum occupancy limits must be observed at all times due to:
safety,
insurance requirements,
septic limitations,
and respect for neighboring properties.
Many Vacation Wimberley properties operate on septic systems. Guests agree not to flush wipes, feminine hygiene products, paper towels, grease, food waste, chemicals, or other non-septic-safe materials. Guests may be responsible for damages or service calls resulting from misuse of septic systems.
Unauthorized gatherings, parties, weddings, or events are prohibited unless expressly approved in writing.
Commercial photography, filming, content creation, styled shoots, workshops, events, or other business-related use of the property are prohibited unless expressly approved in writing by Vacation Wimberley.
Vacation Wimberley properties are intentionally designed for rest, connection, and enjoyment of the surrounding Hill Country landscape.
Guests agree to:
respect neighbors and nearby properties,
observe quiet hours between 9:00 PM and 8:00 AM,
avoid disruptive conduct,
and treat the home and furnishings with care.
Excessive noise, illegal activity, unsafe behavior, or violation of this Agreement may result in immediate termination of the reservation without refund.
Unless otherwise arranged in writing:
Check-in begins at 4:00 PM
Check-out is by 11:00 AM
Unauthorized late check-outs may result in additional fees.
Guests agree to leave the property in reasonably tidy condition, including:
placing trash in designated containers,
locking doors and windows,
and reporting damages or maintenance concerns promptly.
No refunds will be issued for early departures, unused nights, weather conditions, or changes in travel plans outside the control of Vacation Wimberley.
Select Vacation Wimberley properties are pet-friendly and welcome approved dogs when included as part of the reservation.
All pets must:
be disclosed during booking,
be included in the reservation guest count where applicable,
and have the required pet fee paid for each pet staying at the property.
Undisclosed pets or unpaid pet fees may result in additional charges and/or cancellation of the reservation.
Guests bringing pets agree to:
supervise pets appropriately,
clean up after pets,
prevent excessive barking or disruptive behavior,
keep pets off furniture where requested,
and ensure pets do not cause damage to the property or surrounding landscape.
Pets must remain on a leash when outside of fenced areas and should not be permitted to roam freely on neighboring properties or surrounding land.
Vacation Wimberley reserves the right to charge additional fees for:
excessive cleaning,
flea treatment,
pet-related damages,
waste removal,
or violations of pet policies.
For the comfort of future guests, pets should not be left unattended inside the property unless securely crated and approved in advance.
Some properties may include:
hot tubs,
fire pits,
hammocks,
outdoor showers,
wildlife viewing areas,
natural terrain,
or other outdoor amenities.
Guests acknowledge these amenities involve inherent risks.
Guests agree:
to supervise children at all times,
to use amenities responsibly,
and to follow all posted safety instructions.
Outdoor fires, fire pits, fireplaces, charcoal grills, or other flame-producing amenities may be prohibited during active burn bans or periods of elevated fire risk as determined by Hays County, local authorities, or Vacation Wimberley.
Guests agree to comply immediately with all burn restrictions, fire safety instructions, and emergency directives communicated before or during their stay.
Use of amenities is entirely at Guest’s own risk.
Guests understand that Texas Hill Country properties may naturally include:
uneven terrain,
stairs,
insects,
wildlife,
native plants,
changing weather,
and rural environmental conditions.
Vacation Wimberley cannot guarantee against encounters with:
insects,
wildlife,
pollen,
weather events,
or other naturally occurring outdoor conditions.
Smoking or vaping inside the home is prohibited unless explicitly stated otherwise.
Guests acknowledge that smoke odors may require extensive cleaning and remediation to restore the property for future guests. Any evidence of indoor smoking or vaping may result in additional charges for:
smoke remediation,
deep cleaning,
damaged furnishings or linens,
ozone or odor treatment,
HVAC servicing,
and related revenue loss if the property cannot be rented during remediation.
Illegal activity of any kind is strictly prohibited and may result in:
immediate eviction,
involvement of law enforcement,
and forfeiture of reservation payments.
Some Vacation Wimberley properties use smart technology, including:
smart thermostats,
Wi-Fi-enabled systems,
and other operational devices intended to improve guest comfort and property efficiency.
These systems are not intended to monitor private guest conversations or activities inside the home.
Bohemian includes a wildlife observation camera located at the bird blind for nature-viewing purposes only.
This camera is not located inside any private guest area or living space and is not intended for guest surveillance.
Vacation Wimberley makes reasonable efforts to maintain all property systems and amenities in good working order. However, temporary interruptions may occur involving:
Wi-Fi,
utilities,
appliances,
HVAC systems,
hot tubs,
weather conditions,
or other systems outside our control.
No refunds will be issued for temporary outages or maintenance issues beyond reasonable control, though we will make every reasonable effort to resolve concerns promptly.
To the fullest extent permitted under Texas law, Vacation Wimberley, LLC and its owners, employees, contractors, and affiliates shall not be liable for:
accidents,
injuries,
illness,
theft,
loss of personal belongings,
travel interruptions,
weather events,
utility failures,
acts of nature,
or guest misuse of the property.
Guests accept full responsibility for their own safety and the safety of all members of their party.
Guest agrees to indemnify and hold harmless Vacation Wimberley, LLC from any claims, liabilities, damages, losses, expenses, and reasonable attorneys’ fees arising from:
Guest occupancy,
violations of this Agreement,
negligent behavior,
or misuse of the property or amenities.
Guests are responsible for monitoring local weather conditions and emergency notifications during their stay.
Vacation Wimberley strongly encourages Guests to:
keep Wireless Emergency Alerts enabled on their mobile devices,
monitor local weather forecasts during periods of severe weather,
and register for regional emergency alerts through Warn Central Texas prior to arrival.
Texas Hill Country weather conditions can change rapidly, including risks associated with flash flooding, severe storms, wildfire conditions, and road closures.
Guests are responsible for making informed decisions regarding travel, outdoor activities, and evacuation recommendations during their stay.
Vacation Wimberley shall not be held responsible for circumstances beyond reasonable control, including but not limited to:
severe weather,
flooding,
wildfire,
utility outages,
governmental actions,
public health emergencies,
road closures,
or acts of God.
This Agreement shall be governed under the laws of the State of Texas.
Any disputes arising under this Agreement shall be handled in the appropriate courts located in Texas.
By completing a reservation, submitting payment, checking the acceptance box during booking, or occupying the property, Guest acknowledges that they:
have read this Agreement,
understand its terms,
and agree to abide by all conditions outlined herein.
